Terms & Conditions
-
These terms apply to all orders for fabric, wallpaper and trimmings placed with Imogen Heath Interiors Ltd
(company number 16708442), 253 Ditchling Road, Brighton, BN1 6JD.
-
Our pro forma invoice is our offer to supply the goods on these terms. Paying it confirms your order and your acceptance of these terms.
Please check that the pro forma shows the correct design, colourway, base cloth or wallpaper substrate, and quantity. We cannot accept claims for goods ordered in error.
Orders placed by telephone must be confirmed in writing. We are not responsible for errors in an order that has not been confirmed in writing.
-
Prices exclude VAT and delivery unless stated.
Orders are payable in full before production or dispatch.
For export orders the customer acts as importer and is responsible for any import duty and tax.
-
Samples are provided for guidance only. Our fabrics and wallpapers are printed in batches to a commercial tolerance, and we cannot guarantee an exact match in colour between a sample and the goods delivered, or between one batch and another.
Colours shown on screen are not accurate, so please order a sample, and always compare colour in natural daylight.
We print with several UK mills. Our current samples carry a date on the label. If your sample has no date, or you are unsure, please ask us for a current one before you order.
-
We will tell you at the point of order if we advise a cutting for approval. There is no charge for a CFA we have advised.
A CFA may be requested free of charge for orders over 5m / 5 yards, provided it is requested before payment.
A CFA requested after payment, or for an order of 5m / 5 yards or less, is charged at £55 / $65.
If we have stock, the cutting will come from production. If not, it will come from our colour matched production standard.
Whether or not a CFA has been sent, the order must still be checked on arrival as set out below.
-
Our designs are drawn by hand, and the irregularities of a hand drawn line are part of the design. Over a large area, one or more elements of any design will form a visible repeat. These are characteristic of the design.
Slubs, small variations in weave and differences in how the cloth takes colour are characteristic of the cloth.
A flaw is a localised weaving or printing fault. Variation in colour within tolerance, and the natural character of the cloth, are not flaws.
Where a piece has a flaw, we will ask for your cut lengths so that we can supply your order around it.
-
Our wallpapers are produced on more than one substrate. We will tell you at the point of order which paper your design will be printed on.
Please order enough for the whole project in one order, and we recommend at least one extra roll. We cannot guarantee a match between batches.
Please follow the hanging instructions supplied with your order. We cannot accept claims for shortages or damage arising from installation.
-
Changes and cancellations must be requested in writing.
An order cannot be changed or cancelled once it has been cut from stock or put into production.
All sales are final. Our goods are cut and printed specifically for your order, so we do not accept returns or exchanges, other than as set out in clause 15.
If you need to add to an order, we will supply from the same batch where we can. Where that is not possible, the additional goods will come from a different batch and we recommend a CFA.
-
All orders must be checked against your sample or CFA within 7 days of delivery, and before they are cut, treated, made up or hung.
Velvet must be unrolled and checked immediately on arrival.
Please make sure your fabricator, upholsterer or installer carries out this check before starting work.
-
Flame retardant treatments, stain protection, backing and lamination can alter the colour, handle and width of a fabric and may cause shrinkage. A cutting must be treated and approved before the full order is treated.
We cannot accept responsibility for any treatment, backing or lining that we have not carried out ourselves.
Suggested uses for our fabrics are a guide only. Whether a fabric is suitable for a particular use, and whether it needs a backing or interliner, is the responsibility of the customer and their upholsterer or maker.
Our fabrics pass the cigarette test as supplied. To meet the relevant fire safety standards for upholstery they must be used with a suitable FR interliner or be FR treated.
-
Our fabrics are dry clean only. We recommend a specialist dry cleaner using a mild process. Even gentle dry cleaning can cause some shrinkage and fading.
Our fabrics are printed with water based pigments and cannot be guaranteed against fading, particularly in direct sunlight.
Linen and other natural fibres react to moisture in the air and will shrink or relax over time. Please ask your maker to allow for movement of up to 3 to 5% in length and width. This is the nature of the cloth.
We cannot accept claims for shrinkage or fading, or for damage caused by cleaning or conditions of use.
-
Any issue must be reported to us in writing within 7 days of delivery, with your order number and photographs taken in daylight.
No claim, refund or replacement can be made once fabric has been cut, treated or made up, or once wallpaper has been hung.
Where we accept a claim, we will replace the goods. We are not liable for making up, upholstery, treatment, installation, labour or any other associated costs.
Claims for non delivery must be made in writing within 7 days of the expected delivery date.
-
Lead times are estimates given in good faith, based on normal production and shipping times, and are not guaranteed. We will tell you as soon as we can if a lead time changes.
-
Risk in the goods passes to you when they are dispatched or collected. Ownership passes to you once we have received payment in full.
-
If you are a private customer and buy samples or other stock items through our website, you may cancel within 14 days of delivery. Return postage is at your cost unless the item is faulty.
-
If you are buying as a private individual and not in the course of a business, nothing in these terms affects your statutory rights.
-
These terms are governed by the law of England and Wales.
